Terms of Service
These Terms of Service ("Terms") govern your access to and use of the The Milestone Kid website and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
What the Service is
The Milestone Kid offers tools to help families record daily observations, track milestones and activities, view insights, use optional AI-assisted coaching and summaries, and—on eligible plans—use IEP-oriented helpers. The Service is a personal productivity and journaling-style tool, not a medical device, clinical service, or replacement for teachers, therapists, physicians, or other licensed professionals.
Not professional advice. Nothing in the Service (including AI-generated text) is medical, psychological, legal, or educational advice, and it is not a diagnosis or treatment plan. Always rely on qualified professionals for clinical, therapeutic, and eligibility decisions. In an emergency, contact local emergency services.
Eligibility and accounts
You must be able to form a binding contract in your jurisdiction and use the Service only for lawful purposes. You are responsible for the accuracy of information you enter and for maintaining the confidentiality of your login credentials. Notify us promptly if you suspect unauthorized access to your account.
If you invite or connect other adults (for example care-team features where available), you are responsible for ensuring you have permission to share information you disclose through the Service.
Subscriptions, trials, and billing
Some features require a paid plan. Plan names, limits (such as number of child profiles), trial length, and pricing are described in the product. When you purchase a subscription, our payment processor will charge you according to the plan you select and its billing cycle.
- Trials. If we offer a free trial, it converts to a paid subscription only if you complete checkout and authorize billing as shown in the product.
- Changes and taxes. We may change prices or plans with reasonable notice where required. Taxes and fees may apply based on your location and are determined at checkout.
- Cancellation. You may cancel or manage billing through the customer portal or controls linked from Settings, subject to the payment provider's flow.
Acceptable use
You agree not to:
- Use the Service in violation of law or third-party rights.
- Attempt to probe, scan, or breach security, or access data that is not yours.
- Reverse engineer, scrape, or overload the Service except as allowed by applicable law.
- Upload malware or use the Service to send spam or deceptive content.
- Use AI features to generate unlawful, harmful, or abusive content, or to misrepresent AI output as human professional advice.
We may suspend or terminate access for conduct that we reasonably believe violates these Terms or harms the Service.
AI-generated content
Features that use artificial intelligence may produce inaccurate, incomplete, or inappropriate content. You are responsible for how you use outputs—for example, double-checking important decisions with professionals. Do not rely on the Service as the sole source of information about eligibility, services, or health.
IEP tools
IEP helpers are designed to summarize and organize information you provide so you can prepare for conversations with your school team. They do not replace official IEP documents, school records, or professional interpretation. Uploaded documents are not retained as files; see our Privacy Policy for how analyses are stored and deleted.
Intellectual property
The Service, including its design, branding, and software, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes in line with these Terms. You retain ownership of content you submit; you grant us a license to host, process, and display that content as needed to operate the Service for you.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LIMITATION IS PROHIBITED BY LAW.
Indemnity
You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your content, or your violation of these Terms, to the extent permitted by law.
Changes to the Service or Terms
We may modify or discontinue features, or update these Terms, from time to time. We will post updated Terms on this page and change the "Last updated" date. If you continue to use the Service after changes become effective, you agree to the revised Terms. If you do not agree, you must stop using the Service.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction require otherwise. You agree to bring claims only in the courts located in Delaware, unless applicable law requires a different venue.
